Even when a workers’ compensation claim is not denied outright, the injured worker may still struggle to receive full benefits for their injuries. Often, after their workers’ comp claim is approved, they will be forced back to work before their injuries have fully healed, cutting short their recovery time and further increasing their risk of a subsequent injury.
If you were forced back to work before your injury was fully healed, it’s important to remember that your workplace injuries afford you a certain set of legal rights. Our Atlanta workers’ compensation attorneys understand how to protect these legal rights, and can work to ensure you receive the recovery time needed to heal your injuries. Contact us today through our free case review form and our lawyers will determine, at no cost to you, whether they can assist with your claim.
During independent medical examinations, the employee will be examined by a company doctor, who is often placed under pressure from employers and insurance adjusters to limit or deny workers’ comp benefits. Often, when being treated by a company doctor, the injured employee will be told they can return to duty, even if they are not fully healed. The employee may be assigned to full duty or to light duty based on a physical assessment form, which the company doctor will complete upon examination. Then, the insurance company will send the employee a Notice of Ability to Return to Work, which will end, suspend or reduce the workers' compensation benefits.
If you were injured at work, it’s important to keep in mind that workers’ comp insurance companies and company doctors understand how to navigate the system and may work to limit or deny your claim. By hiring a workers’ compensation attorney, however, you may be able to level the playing field against the insurance company. To find out if our attorneys can help recover maximum benefits and recovery time for your injuries, contact us today for a free case review.
